Executive Summary
Resolution 2002-5865 limits routine maintenance, repair and/or installation work along the San Marcos Boulevard public right-of-way, from Knoll Road to the westerly city limits, that necessitates a lane closure, in either direction to night time off-peak hours or on weekends. Resolution 2022-9034 provides a waiver process relating to the restrictions. The proposed resolution would repeal Resolutions 2002-5865 and 2022-9034 in their entirety.
Discussion
On May 14, 2002, City Council executed Resolution 2002-5865 which limited routine maintenance, repair and/or installation work along the San Marcos Boulevard public right-of-way, from Knoll Road to the westerly city limits, that necessitated a lane closure, in either direction to night time off-peak hours (7:00 p.m. to 6:00 a.m.) or on weekends. This resolution was enacted to help address traffic congestion and delays resulting from this type of work due to the significant residential and commercial growth and increased traffic in the City.
However, in doing so the Resolution limited City staff’s ability to perform repairs and other types of routine maintenance along San Marcos Boulevard due to the increased cost and complexity of completing these tasks during the designated off-peak hours. Therefore, on June 28, 2022, City Council approved Resolution 2022-9034 allowing a permanent waiver for City staff and designated City contractors performing these types of routine maintenance, to work weekdays during the City’s typical standard daytime working hours. However, these waivers have become a more common and frequent item as it is more cost-effective and time-efficient to complete these projects during typical standard daytime working hours. Additionally with advances in traffic signal timing, detection, and coordination software and technologies traffic congestion and delays on San Marcos Boulevard can be mitigated thereby still adhering to the intent of the original Resolution.
With these factors in consideration, and in an effort to better align and provide consistency on City policies pertaining to construction related activities and working hours on San Marcos Boulevard and other arterial roadways, the recommended Resolution would repeal Resolutions 2002-5865 and 2022-90234. Repeal of the same would not alter the ability of the City Manager, or their designee, to review and require projects, at their discretion, that are deemed to substantially impact traffic conditions along San Marcos Boulevard to be constructed during night time off-peak hours or weekends on a project However -by-project basis. This would apply to the construction working hours relating to private land development projects and right-of-way encroachment permits on San Marcos Boulevard. Additionally, permits and other approvals found to affect traffic will continue to be conditioned to perform work during off-peak times or at night.
Environmental Review
The proposed action is not a “project” as defined under Section 15378 of the California Environmental Quality Act Guidelines (California Code of Regulations, Title 14, Division 6, Chapter 3, Sections 15000 - 15387), and is therefore not subject to environmental review pursuant to Guidelines Section 15060(c)(3).
Fiscal Impact
There is no fiscal impact directly associated with this Resolution, however, by repealing Resolutions 2002-5865 and 2022-9034 allowing typical standard daytime working hours for City related CIP public works projects, should result in reduced construction related costs which would reduce costs to CIP budgets associated for work on San Marcos Boulevard.
