Executive Summary
The final map from KB Home California LLC is a subdivision of 34 residential lots, one water quality lot, four future unit lots, three slope lots, four fire buffer lots, two biological open space lots, and one private street lot. The development of 187 single-family residential units will be located on 265.07 acres at the northern terminus of N. Las Posas Road, directly north of the Santa Fe Hills community in the College Area neighborhood.
Discussion
On November 15, 2016, the City Council approved the entitlements for the San Marcos Highlands Project, including a Specific Plan Amendment, Pre-zone, Tentative Subdivision Map, Ridgeline Development Permit, Conditional Use Permit, General Plan Amendment, and Final Environmental Impact Report (P13-0009: SP13-001, PZ 14-001, TSM 13-001, ROZ 14-001, CUP 13-010, GPA 15-002, and FEIR 15-001). On December 13, 2016, the City Council adopted the Amendment of the San Marcos Highlands Specific Plan (SP13-001).
The filing of the map will constitute the vacation and abandonment of those public easements not shown on the Final Map. The easements to be abandoned are an Easement for Slope and Incidental Purposes in favor of City of San Marcos, recorded 6/26/1991 as instrument number 91-0310076 and 91-0310077; and an Easement for Drainage and Slope and Incidental Purposes in favor of City of San Marcos recorded 12/18/2003 as instrument number 2003-1487521. The easements to be vacated and abandoned are unnecessary for present or prospective public purposes.
After review of the submitted final map and the project conditions, City staff has determined that the final map is complete and in conformance with the Subdivision Map Act, the City of San Marcos Subdivision Ordinance, and the conditions of approval for the associated entitlements listed above.
Environmental Impact
The proposed Project/action has been reviewed for compliance with the California Environmental Quality Act and has been found to be in conformance with an existing certified environmental document. On November 15, 2016, the City Council approved the entitlements for the San Marcos Highlands Project, including Final Environmental Impact Report FEIR 15-001. The Notice of Determination was filed with the State of California Office of Planning and Research as SCH No. 1999071007.
Fiscal Impact
There are no direct fiscal impacts associated with the adoption of this resolution. However, the ultimate development of 187 residential units will improve the City’s property tax/sales tax base.
Annexation into the following Community Facility Districts (CFDs) ensures the project pays its share toward affected citywide services:
CFD 98-01 Improvement Area 1 (Police Only); San Marcos Fire Protection District CFD 2001-01 (Fire); CFD 98-02 (Lighting, Landscaping, Open Space and Preserve Maintenance) with a Special Improvement “F-zone” Area; and CFD 2011-01 (Congestion Management).
Annexation has not been completed to date. A covenant will be recorded against the property prior to, or concurrent with, the recordation of the Final Map to ensure completion of annexation to the appropriate CFDs.
