Introduction

As a condition of development, private properties are required to pay their fair share of costs relating to infrastructure and services.  This involves annexation of the property being developed into various community facilities districts.  Because the annexation involves the levy of a special tax, the annexation process requires an election to be held.

 

Discussion

The proceedings call for an election to be held by the qualified electors of the area proposed for annexation to Community Facilities District 98-02, Improvement Area F-55. Since no one currently resides on the property, the qualified electors are the landowners.  A special election was held on August 9, 2017, resulting in 100% percent of the votes cast in favor of the annexation.  State law requires that the proposition pass with a two-thirds majority.  With over two-thirds of the voters cast having voted affirmatively, the City is authorized to complete the annexation process and to collect the annual special tax.

 

Fiscal Impact 

There is no fiscal impact to the City as a result of this action, other than the staff time required to finalize the Notice of Special Tax Lien and have the document recorded.
