Introduction

California Community Redevelopment Law (“CRL”), and specifically section 33433 (c) (1) of the Health & Safety Code, requires that a report be filed with the legislative body within 30 days after the end of the Agency fiscal year, which identifies any sale or lease of a “small housing project” as defined by that section.

Discussion

CRL requires that the Successor Housing Agency (“SHA”) must file an annual progress report with the legislative body within 30 days after the end of the Agency fiscal year, which report must identify any sale or lease of a small housing project.  Health & Safety Code section 33431 allows that any lease or sale made pursuant to Section 33430 may be made without public bidding, but only after a public hearing.  The Agency must file a report with the legislative body for any lease or sale pursuant to Health & Safety Code section 33431.  This report is submitted to comply with the law.

The SHA has sold six such properties during the last two fiscal years.  These properties consisted of lots within resident-owned mobile home parks, the conversion of which were assisted by the former Redevelopment Agency (RDA) several decades ago.  These lots were owned under a bifurcated ownership arrangement, in which an individual owned the manufactured housing unit and the RDA owned the space on which the unit was sited.  Under this arrangement, the individual was both a homeowner and a tenant at the same time.  The RDA became the landlord collecting monthly rent payments and encountering the landlord-related responsibilities and obligations vis-à-vis the various Homeowners’ Associations.  These obligations included, for example, the obligation to pay homeowner assessments and fees if they remained unpaid by the tenant.

The Report is provided as an attachment.  It discloses the following:

1.  The name of the buyer

2.  The legal description or street address of the property

3.  The date of the sale

4.  The consideration for which the property was sold

5.  Date on which the Agency held a public hearing on the 2006 resolution which permitted the sale of small housing projects as defined above

Fiscal Impact
