Executive Summary
The Irrevocable Offer to Dedicate a public street, drainage, and utility easement recorded November 21, 2024 as Document 2024-0324782 can be accepted by the City to effectuate the easement offered therein. Staff recommend the easement be accepted to facilitate the construction of public street improvements for Barham Drive as part of the Block F Student Housing project.
Discussion
Government Code Section 7050 provides that an irrevocable offer of dedication of real property for any public purposes including but not limited to streets, utility, drainage, and access rights, when recorded in the office of the county recorder, may be accepted at any time by the city council.
An irrevocable offer to dedicate the subject portion of Barham Drive for a public street, utility, and drainage easement was recorded with the San Diego County Recorder’s Office as Document 2024-0324782 on November 21, 2024.
The acceptance of this irrevocable offer to dedicate allows for construction and public maintenance of Barham Drive street improvements including a sidewalk, separated bicycle facility, and appurtenances as part Block F Student Housing project.
Environmental Review
The proposed project and action have been reviewed for compliance with the California Environmental Quality Act (CEQA) and have been found to be in conformance with the University District Specific Plan 2022 Addendum to the previously certified Final Environmental Impact Report (SCH No. 2008101083).
Fiscal Impact
Annexation into the following Community Facility Districts (CFDs) ensures the project pays its share toward affected citywide services: CFD 98-01 Improvement Area 1 (Police Only); San Marcos Fire Protection District CFD 2001-01 (Fire and Paramedic); CFD 98-02 (Lighting, Landscaping, Open Space and Preserve Maintenance); and CFD 2011-01 (Congestion Management). Future City maintenance of the Barham Drive improvements is funded by CFD 98-02.
