Executive Summary
The Mayor has requested that the proposed resolution regarding supporting Prop 36, the Homelessness, Drug Addiction, and Theft Reduction Act, be presented for City Council consideration. This is a bipartisan measure that provides targeted reforms to Prop 47 that legislative proposals alone are unable to deliver. Cal Cities is in support of the initiative.
Discussion
The passing of Proposition 47 achieved notable success in making California’s criminal justice system more equitable. However, unintended consequences of Prop 47 include repeat and often organized retail theft, inner-city store closings, and difficulty convincing people to seek drug and mental health treatment. These unintended consequences can only be corrected by the voters at the ballot box with modest amendments through the adoption of Proposition 36, the Homelessness, Drug Addiction, and Theft Reduction Act. Bipartisan measure authors regard these changes as common sense, targeted reforms to Prop 47 that legislative proposals alone are unable to deliver.
Environmental Review
The proposed action is not a “project” as defined under Section 15378 of the California Environmental Quality Act Guidelines (California Code of Regulations, Title 14, Division 6, Chapter 3, Sections 15000 - 15387), and is therefore not subject to environmental review pursuant to Guidelines Section 15060(c)(3).
