Executive Summary

The City of San Marcos owns and operates the Civic Center complex, which is made up of 3 buildings and a parking structure. The City Hall building is part of the City’s revenue-generating Enterprise Real Estate Portfolio, which contributes non-tax revenue towards the City’s General Fund. As part of upkeep and maintenance duties, waterproofing work is required for the parking structure, which had been included in the FY 2025-26 Adopted Annual Operations & Capital Improvement Program Budget. The project will ensure compliance with lease terms as a landlord, maintain marketability of the spaces, and also ensure safety of the structure for visitors to City Hall and the Community Center who park in the structure.

On behalf of the City, the City’s real property management consultant initiated a request for proposal (RFP) for the waterproofing work at the parking structure at the Civic Center Complex on November 21, 2025, which resulted in no bids. In accordance with the San Marcos Municipal Code procurement requirements, the City’s property management group then solicited informal bids from other companies and received two proposals.

Staff reviewed the proposals, and seeks City Council approval to award the contract to Structural Preservation Systems for waterproofing of the Civic Center parking structure, and to authorize the City Manager to negotiate, finalize, and execute contract documents.

Discussion

The City operates a real estate portfolio as part of the fulfillment of Section 203 of the San Marcos Charter, which emphasizes enterprise activities designed to produce non-tax revenue sources. The City leases out portions of floor 1 and 2, and the entirety of floor 3 and 4 of the City Hall building, the proceeds from which contributes revenue towards the City’s General Fund each year. As a commercial real estate operator, the City is required to maintain the buildings and common spaces patroned by tenants and customers for safety, aesthetic, and legal purposes.

A request for proposal (RFP) for re-roofing was issued on November 21, 2025 for waterproofing of various sections of the parking structure at the Civic Center complex (building 4). The request for proposal was advertised by IDS Real Estate, as the City’s real property management consultant, on behalf of the City. Subsequently, no bids were received as a result of the request for proposal. Per City Municipal Code 2.30.060, informal bids were then solicited directly from three firms, resulting in two proposals. Of the two proposals, Structural Preservation Systems was deemed to be a qualified firm for the work, and the selection of Structural Preservation Systems resulted in a significant cost savings compared to the competing proposal.

The proposal outlined the work needed, which includes waterproofing of large sections of the parking structure which are currently experiencing issues with moisture, including electrical rooms, facades, and other areas of the parking structure. The re-paving work will fulfill requirements of the City as the landlord to maintain a parking structure that is safe, well-maintained, and free of any potential hazards.

The FY 2025-26 budget for the project is sufficient to cover the proposed contract with Structural Preservation Systems, as well as potential change orders, additional support work, labor compliance, and other project-related items.  Staff reviewed the proposal for the project and seeks City Council approval to award the waterproofing contract to Structural Preservation Systems in the amount of $675,542 for waterproofing work, and to authorize the City Manager to negotiate, finalize, and execute an agreement with Structural Preservation Systems.

Environmental Review

Not applicable.

Fiscal Impact

The funding for the contract is budgeted in the Fiscal Year 2025-26 Adopted Annual Operations & Capital Improvement Program Budget as building improvement costs in the Real Property Management Fund (605). The contract award does not result in a change to the overall Real Property Management Fund Budget.
