Executive Summary
The proposed action would authorize a professional services agreement with Dudek for the 5-year mitigation and monitoring period in conformance with the Creek District’s Specific Plan permit requirements. Services would include the maintenance of the approximately 70 acres of habitat established as part of the City’s Creek Infrastructure Project (CIP # 88263, 88264, 88265, 88505,88507, 88529). Through the City’s Request for Proposals (RFQ) process, Dudek was deemed the most qualified consultant to execute these requirements. Staff recommends that the City Council delegate to and authorize the City Manage to negotiate, award, finalize, and execute the agreement with Dudek for the aforementioned services.
Discussion
As part of the City of San Marcos’ Creek Specific Plan Infrastructure Project permits, the City is required to implement a five-year environmental habitat mitigation and monitoring plan. This plan includes activities such as protecting and restoring natural wildlife habitat areas after they’ve been affected by construction and using qualitative and quantitative methods to report the health of the environmental habitat, including bids, wildlife, and vegetation.
On May 16, 2024, the City issued a Request for Proposals (RFP) to solicit experienced and qualified consultants to implement and monitor the project’s five-year wetland mitigation and monitoring plan. On June 18, 2024, the City received two proposals for the project. A panel of four City staff reviewed and ranked the proposals based on the requirements specified in the RFQ, and Dudek was chosen and the most qualified consultant.
Staff recommends that the City Council adopt the resolution authorizing and delegating the City Manager to negotiate, finalize, and execute a professional services agreement for the project.
Environmental Review
The proposed action is mitigation under approved permits for the San Marcos Creek Infrastructure Project (Project) in compliance with the California Environmental Quality Act (CEQA) and has been found to be in conformance with the previous adopted EIR for the San Marcos Creek Specific Plan. No substantial changes are proposed in the Project and there are no substantial changes in circumstances under which the Project will be undertaken that will require major revisions to the previous EIR due to involvement of significant new environmental effects or a substantial increase in the severity of previously identified significant effects. Additionally, there is no “new information of substantial importance” as that term is used in CEQA Guidelines section 15162(a)(3). Therefore, pursuant to CEQA Guidelines section 15162, the previously certified EIR is adequate without modification.
Fiscal Impact
The project (CIP #88529) is budgeted and approved in the Fiscal Year 2024-2025 Capital Improvement Program Budged.
