Background

The proposed Lennar-Barham project, formerly known as Hallmark-Barham project, would allow for the development of 151 multifamily residential condominiums on an approximately 10.5-acre project site located at 943 E. Barham Drive in the Hallmark-Barham Specific Plan Area (SPA) Zone in the Barham/Discovery Community.

 

Discussion

 

On May 10, 2022, City Council approved the following for the Hallmark-Barham development:

                     Resolution No. 2022-9013 (Environmental Impact Report 21-001) certifying Environmental Impact Report (FEIR 21-001 SCH#2021040009) and adopting findings and overriding considerations for significant and unavoidable impacts related to transportation;

                     Resolution No. 2022-9014 (General Plan Amendment 20-0002) to change the land use designation from “Mixed Use 3” to “Specific Plan Area”;

                     Ordinance No. 2022-1518 (Rezone 20-0001) to rezone parcel 228-310-01-00 in the City from Mixed Use 3 (MU-3) to Specific Plan Area (SPA); 

                     Ordinance No. 2022-1517 (Specific Plan 20-0002) adopting the Hallmark-Barham Specific Plan to establish the development guidelines and serve as the primary land use, policy and regulatory document for the project;

                     Resolution No. 2022-9017 (Tentative Subdivision Map 20-0001) to create a one-lot condominium map for 151 residential condominium units;

                     Resolution No. 2022-9015 (Multifamily Site Development Plan 20-0001) to allow the construction of 151 residential condominium units;

                     Resolution No. 2022-9016 (Conditional Use Permit 20-0007) to allow for the temporary use of a rock crusher during grading operations; and

                     Resolution No. 2022-9018 (Grading Variance 20-0002) to allow manufactured slopes in excess of 20 feet in height within the project site. 

 

After review of the submitted final map and the project conditions, City staff has determined that the Final Map is complete and in conformance with the Subdivision Map Act, the City of San Marcos Subdivision Ordinance, and the conditions of approval for the associated entitlements listed above.

 

The final map effectuates the abandonment of summary vacation of the slope easement, VAC 23-0012, granted by Document 2012-0429406 recorded in the Office of the County Recorder of San Diego County on July 24, 2012.

 

Environmental Impact

The proposed Project/action has been reviewed for compliance with the California Environmental Quality Act and has been found to be in conformance with an existing certified environmental document. On May 10, 2022, the City Council approved the entitlements for the Hallmark-Barham Project, including Resolution No. 2022-9013 certifying Environmental Impact Report FEIR 21-001 and adopting findings and overriding considerations for significant and unavoidable impacts related to transportation.  The Notice of Determination was filed with the State of California Office of Planning and Research as SCH No. 2021040009.

 

Fiscal Impact

There are no direct fiscal impacts associated with the approval of the Final Map. However, the ultimate development of 151 residential condominiums will improve the City’s property tax/sales tax base.

 

Annexation into the following Community Facility Districts (CFDs) ensures the project pays its share toward affected citywide services: CFD 98-01 Improvement Area 1 (Police Only); San Marcos Fire Protection District CFD 2001-01 (Fire and Paramedic); CFD 98-02 (Lighting, Landscaping, Open Space and Preserve Maintenance); and CFD 2011-01 (Congestion Management).  Annexation was completed under the following resolutions: 2022-9013, 2022-9015, and 2022-9017 for Congestion Management; Fire Protection; Lighting, Landscaping, and Open Space; and Police, respectively.
