Executive Summary

Under Title II of the ADA, the City of San Marcos is required to have an up to date Self-Evaluation and Transition Plan (“ADA Transition Plan”) to receive state and federal pass through funding for various eligible program and facility accessibility services. The City of San Marcos currently engages the CJPIA to provide risk management services as well as general liability and property insurance programs. As part of this comprehensive risk management program, a recent risk evaluation was completed related to City’s current ADA Transition Plan.

Discussion

The CJPIA has recommended that the City of San Marcos utilize the ADA Assistance Program, in which it partners with Disability Access Consultants (DAC) to assist member agencies in updating and evaluating the required ADA Transition Plan. As such, City staff recommends entry into an MOU with the CJPIA to engage in the ADA Assistance Program to update the ADA Transition Plan as it relates to City facilities and public right of way.

The ADA Assistance Program includes professional services rendered by DAC to provide surveys of the City’s facilities, parks and inspection of public right-of-way. Also included in the scope of work is a review of the policies, procedures and program set up specific to the City of San Marcos.

Staff recommends authorizing the City Manager to execute a memorandum of understanding and all related documents with the CJPIA for ADA Transition Plan consultant services provided by Disability Access Consultants (DAC).

The MOU discloses all costs related to work to be performed, which will be invoiced to the City by the CJPIA.

Environmental Review

Not applicable.

Fiscal Impact

The reimbursement amount to CJPIA is anticipated to not exceed $347,150. The cost of these services is included within the approved Fiscal Year 2020-21 Operating Budget.
