City Council to Approve and Adopt the following:

1)                     APPROVE Final Subdivision Map for Tentative Subdivision Map (TSM) 22-0003.

2)                     ADOPT Resolutions 2025-9498, 2025-9499, and 2025-9500 accepting Irrevocable Offers of Dedication for Public Street, Drainage, and Utility easements for West San Marcos Boulevard as offered by Document 2025-0093165 and 2015-0517766, and General Utility and Public Pedestrian Access Easement as offered by Document 2025-0093169, respectively.

Executive Summary

The proposed Restaurant Row project would allow for the development of 202 multifamily residential and 30 commercial condominiums on an approximately 10.5-acre project site located at 1020 West San Marcos Boulevard in the Restaurant Row Specific Plan Area (SPA).

The Irrevocable Offers of Dedication for public street, drainage, and utility easements recorded April 11, 2025 as Document 2025-0093165 and October 1, 2015 as Document 2015-0517766 and general utility and public pedestrian access easement recorded on April 11, 2025 as Document 2025-0093169 remain eligible for future acceptance. Staff recommends the easements be accepted to facilitate the construction of public street improvements for West San Marcos Boulevard as part of the Restaurant Row project. 

Discussion

Restaurant Row Final Map

On December 12, 2023, City Council approved the following for the Restaurant Row development:

                     Ordinance No. 2023-1540 (Specific Plan 22-0004) adopting the Restaurant Row Specific Plan to establish the development guidelines and serve as the primary land use, policy and regulatory document for the project;

                     Resolution No. 2023-9245 (Tentative Subdivision Map 22-0003) to create three lots consisting of up to 202 multi-family residential and 30 commercial condominium units; and

                     Resolution No. 2023-9246 (Multifamily Site Development Plan 22-0006) to allow the construction of 202 residential condominium units and 10,400 square feet of commercial space.

After review of the submitted final map and the project conditions, City staff has determined that the Final Map is complete and in conformance with the Subdivision Map Act, the City of San Marcos Subdivision Ordinance, and the conditions of approval for the associated entitlements listed above.

Irrevocable Offers of Dedication

Government Code Section 7050 provides that an irrevocable offer of dedication of real property for any public purposes including, but not limited to streets, utility, drainage, and access rights, when recorded in the office of the county recorder, may be accepted at any time by the city council.

The portions of San Marcos Boulevard as public street, utility, and drainage easements were offered as irrevocable offers to dedicate by Document 2025-0093165 on April 11, 2025 and by Document 2015-0517766 on October 1, 2015 recorded with the San Diego County Recorder’s Office. Additionally, an irrevocable offer to dedicate for general utility and public pedestrian access easement was offered by Document 2025-0093169 on April 11, 2025 recorded with the San Diego County Recorder’s Office.

The acceptance of these irrevocable offers of dedication allows for construction of public street improvements for West San Marcos Boulevard local access lane, median, storm drain facilities, sidewalk, landscaping, and associated utilities as part of the Restaurant Row project and City’s future maintenance of the constructed public improvements.

Environmental Impact

The proposed project and actions have been reviewed for compliance with the California Environmental Quality Act and have been found to be in conformance with an existing certified environmental document. On December 12, 2023, the City Council approved the entitlements for the Restaurant Row Project, including Mitigated Negative Declaration ND23-011 identifying mitigations measures to reduce project impacts to less than significant.  The Notice of Determination was filed with the State of California Office of Planning and Research as SCH No. 2023080476.

Fiscal Impact

There are no direct fiscal impacts associated with the approval of the Final Map. However, the ultimate development of 202 residential and 30 commercial condominiums will improve the City’s property tax/sales tax base.

Annexation into the following Community Facility Districts (CFDs) ensures the project pays its share toward affected citywide services: CFD 98-01 Improvement Area 1 (Police Only); San Marcos Fire Protection District CFD 2001-01 (Fire and Paramedic); CFD 98-02 (Lighting, Landscaping, Open Space and Preserve Maintenance); and CFD 2011-01 (Congestion Management). Future City maintenance of the West San Marcos Boulevard improvements will be funded by CFD 98-02.
