Recommendation

APPROVE the following:

 

1.                     APPROVE Resolution PC 26-5217 (Time Extension TE26-0001) granting a three-year time extension of a Tentative Subdivision Map (TSM24-0001) to establish two residential lots, one open space lot, 116 residential condominiums on Lot 1, and 112 residential condominiums on Lot 2 within the 33.2-acre Pacific Specific Plan area.

Background

On June 17, 2024, the Planning Commission recommended approval of a Tentative Subdivision Map (TSM24-0001) to the City Council by a 6 to 0 vote. TSM24-0001 was recommended for approval to City Council in conjunction with a Specific Plan (SP22-0001 - Pacific Specific Plan), a General Plan Amendment (GPA21-0002) and Rezone (R21-0002) to change the site’s designation from Industrial (I) to Specific Plan Area (SPA), and a Multi-Family Site Development Plan (MFSDP24-0001) for the development of 228 condominiums. Planning Commission minutes are included in Attachment B.

 

On July 23, 2024, the Tentative Subdivision Map (TSM24-0001) was approved by the City Council by 4 to 0 vote to create two development parcels and one open space parcel while establishing 228 residential condominiums. The original City Council staff report is included in Attachment C.

 

The Tentative Subdivision Map (TSM24-0001) will expire on July 23, 2026, unless extended by the Planning Commission as stipulated in Condition G of City Council Resolution No. 2024-9326.

 

The applicant has requested a three-year time extension for additional time to prepare the Final Map and complete the process prior to expiration of the tentative subdivision map on July 23, 2026. The proposed tentative subdivision map would create two developable lots and one open space lot from the four existing lots on the 33.2-acre site, while establishing 228 residential condominiums. The tentative subdivision map includes an approximate 15.3-acre open space lot for the enhancement and preservation of sensitive biological resources. Frontage improvements and dedication for public street right-of-way, including an urban trail along Linda Vista Drive and La Mirada Drive, are also included with the project.

 

Staff supports the requested time extension given the permitting complexities and time commitment related to the enhancement, restoration, and preservation of the biological open space area. The applicant, The Las Posas Owner, LPV, LLC, is acting on behalf of Lennar Homes of California, who is in the process of completing construction drawings for the 228-unit multifamily project including improvement, grading, landscaping, and construction plans. The applicant has indicated they are actively working towards obtaining required regulatory permits from the United States Army Corps of Engineers (USACE), Regional Water Quality Control Board (RWQCB), and California Department of Fish and Wildlife (CDFW).

 

Resolution PC 26-5217 for the requested time extension carries over the conditions of approval for TSM24-0001 from the previously approved City Council Resolution No. 2024-9326 (Attachment D).

 

Environmental Review

In accordance with the California Environmental Quality Act (CEQA), an Environmental Impact Report (EIR24-002) was certified by the City Council for the Pacific Specific Plan (SCH No. 2022050650) on July 23, 2024. No additional environmental review is required for the requested time extension since the project is within the scope of the Final Environmental Impact Report (FEIR) and no new environmental information or documentation was presented in review of the requested time extension revealing any new unidentified environmental impacts which had not been previously mitigated.
