Executive Summary

Approval of the attached resolution would authorize Amendment No. 7 to the City’s contract with Dudek (Agreement 6457), which provides on-call construction management, inspection, environmental and other field services.  Per the City’s Purchasing Ordinance, City Council action is required for approval as the increase is greater than 10% of the existing contract value.

 

Discussion

The agreement, originally approved at $2,500,000, provides construction management, surveying, inspection and material testing support for capital improvement projects and private development projects over a five-year period.  Previous amendments increased the contract amount by $250,000, which raised the total value to $2,750,000, and extended the contract term to March 2027. 

 

However, an additional contract amendment is needed to continue providing these services and to help supplement staff work due to the current vacancy of the construction manager position and to maintain coverage for capital improvement projects. Contract services are planned to be utilized for projects such as the Annual Surface Seal Project, CIP Project ST011, and Roadway Rehabilitation Project, ST022, which will commence work this summer.  Additionally, the contract will continue to provide services for private development, utility projects, and other capital improvement projects on an as-needed basis to supplement inspection services.

 

Staff recommends that the City Council approve Amendment No. 7 to Agreement 6457 with Dudek in the amount of $1,000,000, increasing the total not-to-exceed contract amount to $3,750,000.  Because the amendment exceeds the City Manager’s authority for dollar value threshold of change orders/amendments under Municipal Code Section 2.30.030(c), staff seeks Council approval for the City Manager to finalize and execute Amendment No. 7.

 

Environmental Review

Section 15378(a) of the California Environmental Quality Act (CEQA) Guidelines (California Code of Regulations, Title 14, Chapter 3) defines an activity as a “project” if it has the potential to result in either a direct, or reasonably foreseeable indirect, physical change to the environment. The proposed contract amendment is not a project within the meaning of CEQA because there is no potential for it to result in a physical change in the environment, either directly or indirectly.

 

Fiscal Impact 

Approval of the proposed action increases the total not-to-exceed amount of the contract with Dudek to $3,750,000. The additional $1,000,000 authorized under this amendment will be paid with existing budgeted funds; therefore, no additional appropriations will be needed, and there will be no impact to the operational budget.
