Introduction
CFD 2011-01 was formed in 2011 by the City Council pursuant to the provisions of the "Mello-Roos Community Facilities Act of 1982." The purpose of CFD 2011-01 is to mitigate the impacts of development on transit service, traffic congestion and air quality. The owners of the properties listed below have consented and elected to annex into CFD 2011-01.
 
Discussion
Prior to the issuance of a building permit, or as a condition of a conditional use permit, the owners of the properties listed below were required to mitigate their traffic impacts by either paying an in lieu fee or by annexing into CFD 2011-01. The property owners have chosen to mitigate their traffic impacts by annexing to CFD 2011-01.  They have approved such annexation by signing a "Consent and Waiver to Shortening of Time for Conducting a Special Election," and casting a ballot in the affirmative that authorizes the CFD 2011-01 special tax to be levied on their respective properties. The attached resolution will certify the election results and annex said properties into CFD 2011-01.

The amount of the special tax to be levied against these parcels was calculated in accordance with the CFD 2011-01 annexation policy City Council adopted on March 27, 2012.
 
The attached aerial exhibit shows the location of the properties to be annexed into CFD 2011-01.  Also attached is the Rate and Method of Apportionment of Special Tax for CFD 2011-01.  Information about current CFD 2011-01 special tax rates can be found on the City's website
 
Fiscal Impact  
Approval of the attached resolution will result in approximately $50,000 of additional annual revenue for congestion management if the above projects are developed as planned.
