Executive Summary
On June 18, 2026, staff publicly solicited proposals for this work. On July 10, 2026, proposals from D-Max Engineering, Inc. and Mikhail Ogawa Engineering were received. The resolution authorizes the City Manager to select the most qualified, responsible, and responsive bidder and to award a contract in an amount not to exceed $510,000 over two years to the selected consultant.
Discussion
The City of San Marcos is required to comply with the San Diego Region National Pollutant Discharge Elimination System (NPDES) Permit and Waste Discharge Requirements for Discharges from the Municipal Separate Storm Sewer System (MS4) Draining the Watersheds Within the San Diego Region (Municipal Permit) under Order Number R9-2013-0001, as amended by Order Numbers R9-2015-0001 and R9-2015-0100. The City implements various programs to comply with Municipal Permit requirements and regularly requires consultant support services to execute specialized/technical program elements.
The City implements various program elements and strategies to comply with the Municipal Permit through the Carlsbad Watershed Management Area Water Quality Improvement Plan (WQIP) and the City of San Marcos Jurisdictional Runoff Management Plan (JRMP). The following program elements are base tasks to be performed by the proposed consultant to support the City’s Municipal Stormwater Program:
• Existing Development Program
• Agricultural Facility Inspection Program
• Structural BMP Program
• Dry Weather MS4 Outfall Discharge Field Screening and Monitoring
• Bradley Park (Former Landfill) Oversight
• Annual Work Plan and Budget Preparation
Additional tasks are included in the scope of work and will only be authorized if needed. These tasks are included within the not-to-exceed contract amount and include items like the Development Planning Program and WQIP strategy assessment and goal assessment.
As a business practice, maintaining on-call professional services agreements allows the City to remain flexible and responsive while managing resources efficiently. Many of the services included in the proposed scope require specialized technical knowledge that may not be available internally or may only be needed periodically. In these circumstances, it is not practical or cost-effective for the City to hire full-time staff for every specialized service area, particularly when the need for those services is intermittent or task-specific. The proposed agreement would allow the City to access qualified professional expertise when needed without creating ongoing staffing obligations for services that may not be required on a continuous basis.

The City has formed a proposal review committee to evaluate the responsive proposals and to recommend to the City Manager the most qualified, responsible, and responsive bidder. The proposed resolution delegates to and authorizes the City Manager to negotiate, finalize, and award to the selected bidder a contract not to exceed $510,000 over the two-year contract period.
Environmental Review
The proposed award of contract does not have the potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not constitute a “project” as defined by Public Resources Section 21065, and it is therefore exempt from CEQA or other environmental review pursuant to CEQA Guidelines section 15061(b)(3) and 15262.
Fiscal Impact
The costs associated for work performed during Fiscal Year (FY) 2026-2027 have been approved through the Development Services Operation Budget in the General Fund (100). Ongoing costs associated for this work in FY 2027-2028 will be budgeted in the Development Services Operations Budget in the General Fund (100) as well, subject to council approval.
