Executive Summary

The City executes contracts with various contractors and consultants which are required to meet regulatory requirements set by the State and Federal Government related to wages, apprenticeships and DBE compliance. Approval of this resolution will award a multi-year contract for ongoing DBE and labor compliance monitoring and oversight of applicable Citywide projects on an as-needed basis in an amount not to exceed $1,000,000.00 to Gafcon Inc.

Discussion

The Department of Industrial Relations (DIR) sets rules and regulations for public works contracts. Under the rules set by the DIR, the City must meet certain requirements to ensure that contractors are paid prevailing wage, meet apprenticeship standards, as well as meet other employment requirements.  When the City utilizes federal funds for a contract, the contractor must meet federal regulations relating to wages, apprenticeships, and DBE goals. The execution of this agreement prevents the City from paying costly fines, documents that the City is meeting all state and federal requirements, and helps ensure that contractors are remaining in compliance with the law.

The City currently has an as-needed contract with Gafcon Inc. for labor compliance services that is nearing its expiration. On July 30, 2024, the City publicly solicited proposals for professional services relating to labor and DBE compliance and oversight. On August 27, 2024, four proposals were received and evaluated per the terms of the RFP document. After evaluation by City staff, Gafcon Inc. was found to be the most qualified firm to provide these services.

Staff recommend that City Council approve the award of a multi-year contract in an amount not to exceed $1,000,000.00 and authorize the City Manager to negotiate, finalize, and execute the contract and related documents with Gafcon Inc.  This contract is shared by all City departments.

Fiscal Impact

The total contract amount is not to exceed $1,000,000.00. Funding for expected expenditures from services provided by the consultant for Fiscal Year 2024-2025 have been appropriated in the Approved Operations and Capital Improvement Program Budget for all applicable projects. Funding for subsequent services will be budgeted in future fiscal years and subject to Council approval.

Environmental Review

The activity performed under this action is not a “Project” as defined under Section 15378 of the CEQA Guidelines; and, is therefore not subject to environmental review pursuant to CEQA Guidelines section 15060(c)(3).
