Title

RESOLUTION NO. 2026-9619 - AWARDING A TWO-YEAR CONTRACT FOR MONITORING AND ASSESSMENT SERVICES FOR THE CARLSBAD WATERSHED MANAGEMENT AREA

Body

Recommendation
Recommendation

ADOPT a resolution awarding a two year monitoring and assessment contract on behalf of the Carlsbad Watershed Management Area (CWMA) Responsible Agencies (RAs) to NV5 Environmental, LP in the amount of $677,742.00.

Body

Board or Commission Action

Not applicable

Executive Summary

The CWMA RAs include the cities of Carlsbad, Encinitas, Escondido, Oceanside, San Marcos, Solana Beach, and the County of San Diego. The CWMA RAs established a three-member panel to review and evaluate proposals to perform monitoring and assessment services outlined in the municipal storm water permit for the CWMA. Staff recommend awarding the contract for monitoring and assessment services for the CWMA to NV5 Environmental, LP, recommended by the panel as the most qualified, responsible, and responsive bidder.  The contract costs are shared amongst the RAs.

Discussion

RAs are required to collectively monitor and assess the impact on receiving water conditions caused by MS4 discharges during both wet and dry weather conditions as a requirement of the San Diego Region National Pollutant Discharge Elimination System (NPDES) Permit and Waste Discharge Requirements for Discharges from the Municipal Separate Storm Sewer System (MS4) Draining the Watersheds Within the San Diego Region (Municipal Permit) under Order No. R9-2013-0001, as amended by Order Nos. R9-2015-0001 and R9-2015-0100, Provision D. Monitoring and Assessment Requirements.

This proposed work includes the general monitoring and assessment provisions outlined in the current Municipal Permit, including:

•                     Storm Water Monitoring Coalition Regional Monitoring and Reporting

•                     Sediment Quality Monitoring

•                     Receiving Water Assessments

•                     Wet Weather MS4 Outfall Discharge Monitoring and Assessments

•                     Special Study Assessments

•                     Work Plan and Budget Preparation

•                     Project Management and Meetings

•                     Miscellaneous Activities

On April 3, 2026, staff publicly solicited for proposals for this work. On May 4, 2026, the City received two proposals for the services requested.  The review panel evaluated the responsive proposals and identified NV5 Environmental, LP, as the most qualified, responsible, and responsive bidder.

The Municipal Permit expired on June 27, 2018, but it remains in effect under an administrative extension until it is reissued by the San Diego Water Board. The timeline for permit reissuance is currently unknown; however, it is the CWMA Ras’ understanding that the process will likely continue through Fiscal Year (FY) 2028 and beyond. Therefore, the proposed  two-year contract for the work by NV5 Environmental, LP, would commence on July 1, 2026 and end on June 30, 2028.

Staff recommend awarding the two-year contract to NV5 Environmental, LP for a total of $677,742.00.

Environmental Review

The proposed award of contract does not have the potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore does not constitute a “project” as defined by Public Resources Section 21065, and it is therefore exempt from CEQA or other environmental review pursuant to CEQA Guidelines section 15061(b)(3) and 15262.

Fiscal Impact

The proposed contract amount is $677,742.00.  The CWMA RAs will share the cost of this work via the 2024 Fifth Amended National Pollutant Elimination System San Diego Regional Stormwater Copermittees Memorandum of Understanding (Attachment 1).  The City will issue invoices to each RA for their respective share of the total amount invoiced for the fiscal year. The City’s share of costs is funded with General Funds (100).
