Executive Summary

Section 12.20.030(a) of the City’s Municipal Code provides authority for City Council to establish No Parking Areas within the City by resolution. Staff recommends that the City Council consider adopting the proposed resolution to ameliorate excessive long term parking and clearly identify fire lanes in particular areas of the City.

Discussion

Over the past few years and now increasing in number, the City has received complaints regarding the long term parking of vehicles along Pacific Street and the surrounding areas. These vehicles are parked overnight and remain on the streets throughout the day for multiple days at a time. Although the City’s parking enforcement has attempted to enforce 72-hour parking restrictions in these areas, the vehicles move short distances within the area to evade these parking restrictions. The long term parking of these vehicles limits the general public from accessing local businesses and City recreational areas, specifically Bradley Park, and also interferes with regular street sweeping activity which would keep street debris from entering  the storm drain system.  If the Resolution is approved, parking in the designated areas will be prohibited from 11:00 p.m. to 5:00 a.m. on the following streets:

a.                     Pacific Street from southeast corner of Bradley Park north to termination for approximately 3,970 feet.

b.                     La Mirada Drive between Pacific Street and Las Posas Road for approximately 1,450 feet.

c.                     Linda Vista Drive between Pacific Street and Las Posas Road for approximately 1,450 feet.

d.                     Pawnee Street between Grand Avenue and Descanso Avenue.

e.                     Osage Street between Pawnee Street and Navajo Street.

f.                     Seminole Street between Pawnee Street and Pacific Street

g.                     Navajo Street between Grand Avenue and Osage Street.

h.                     Descanso Avenue between Rancho Santa Fe Road and Pawnee St.

i.                     Pawnee Steet between Grand Avenue and La Mirada Drive.

j.                     Creek Street from Pacific Street to west side of Pawnee Street.

k.                     Cherokee Street between Rancho Santa Fe Road and Navajo Street.

l.                     Navajo Street between Grand Avenue and La Mirada Drive.

m.                     La Mirada Drive between Rancho Santa Fe Road and Pacific Street.

n.                     Alpine Place from Pacific Street to termination for approximately 250 feet.

Furthermore, fire lanes in the same area around Pacific Street have not been clearly defined. If this Resolution is approved, no parking areas in fire lanes will be clearly established for the following:

a.                     Alley between Pawnee Street and Navajo Street

b.                     Alley between Navajo Street and Pacific Street

Additionally, it is anticipated that these vehicles may relocate to adjacent areas of the City. Therefore, the approval of this resolution will also authorize the City Manager to further establish No Parking Areas from 11:00 p.m. to 5:00 a.m. at the following locations if and as needed by way of an administrative resolution:

a.                     Grand Avenue between Rancho Santa Fe Road and Las Flores Drive.

b.                     Descanso Avenue between Rancho Santa Fe Road and Pawnee Street.

c.                     Pawnee Street between Grand Avenue and Descanso Avenue.

d.                     Descanso Avenue between CA-78 and Las Posas Road.

e.                     Pacific Street between Descanso Avenue and Mission Road.

f.                     Capalina Road between Pacific Street and Rancho Santa Fe Road.

To enforce these newly created No Parking Areas, signs will be posted along the above locations to notify the public of the parking restrictions and to provide the required warning under the California Vehicle Code of the City’s ability to tow the vehicles for violation of the No Parking restrictions in the above listed locations.

If the City Council approves the proposed resolution, the Council will be establishing areas within the City that prohibit parking from 11:00 p.m. to 5:00 a.m. and clarifying that parking is prohibited in fire lanes in the specified areas. Approval of the resolution will also authorize the City Manager to establish additional streets within a specified area where parking would be prohibited from 11:00 p.m. to 5:00 a.m. if and as needed, by way of an administrative resolution.

Environmental Review

The activity performed under this action is not a “project” as defined under Section 15378 of the California Environmental Quality Act Guidelines (California Code of Regulations, Title 14, Division 6, Chapter 3, Sections 15000 - 15387), and is therefore not subject to environmental review pursuant to Guidelines Section 15060(c)(3).

Fiscal Impact

There will be costs associated with the installation of new signage; however, funding to implement the proposed resolution is currently anticipated to be absorbed within existing budget allocations.
