Executive Summary
The Caltrans Local Agency Procedures Manual requires local agencies to pass resolutions authorizing an individual or individuals to execute federal and/or State funded project agreements as they occur. Beginning in the summer of 2011, the City Council adopted a general federal and State resolution authorizing the City Engineer to execute future Program Supplemental Agreements, Fund Exchange Agreements, and/or Fund Transfer Agreements (Agreements) for eligible grant funded projects. These resolutions are brought forward annually to Council by staff. The attached proposed resolutions provide the City Engineer authority to execute Agreements for the Fiscal Year 2021-2022.
Discussion
In the summer of 2011, the City Council adopted a general federal and State resolution authorizing the City Engineer to execute future Program Supplemental Agreements, Fund Exchange Agreements, and/or Fund Transfer Agreements (Agreement) for eligible federal and/or State funded capital projects as required by Caltrans for grant funded projects. Each year staff brings forward resolutions for the upcoming fiscal year. As a result, an updated general resolution is needed for Fiscal Year 2021-2022.
The Agreement defines the general terms and conditions for receiving funds resulting from federal and/or State grant awards. Requests for reimbursement cannot be processed until the Agreement is fully executed. Additionally, the approval of a general state and federal resolution will reduce processing time for both the City and Caltrans, which will allow projects to be implemented in a timely manner.
The submitted resolutions will allow all future Program Supplemental Agreements, Fund Exchange Agreements and/or Fund Transfer Agreements under the Federal Maser Administering Agency-State Agreement No. 11-5381R and the State Master Agreement No. 00121S, to be executed by the City Engineer or his/her designee. These agreements are on file in the City Clerk’s Office.
Environmental Review
The activity performed under this action is not a “Project” as defined under Section 15378 of the California Environmental Quality Act, State Guidelines; and, is therefore not subject to environmental review pursuant to State Guidelines Section 15060(c)(3).
Fiscal Impact
Approval of the submitted resolutions will allow the City to seek reimbursement for expenses related to current and future grant funds without returning to City Council each time a new agreement must be signed. There is no direct fiscal impact associated with the approval of the resolutions.
