Executive Summary

In 2009, following a competitive bidding process, an agreement (Agreement No. 5587) was entered into between the City of San Marcos and the San Marcos Fire Protection District on one hand and the San Marcos Fire Department on the other to provide advanced life support transport services within the City and the Fire Protection District.

 

That agreement has a term of ten (years) and will expire on September 14, 2019.

 

The County of San Diego (County) has been invested with the legal obligation to manage the selection process and procure advanced life support transport services within the municipal boundaries of the City of San Marcos and the San Marcos Fire Protection District.  Based on all available information provided to the City and Fire Protection District, it appears unlikely that the County will be able to complete that procurement process prior to the expiration of the current agreement.

 

 

Discussion

For approximately one year, the County of San Diego has been engaged in the process of managing the provider selection process for the provision of advanced life support services.  City staff has routinely checked in with County staff to inquire as to the status of the process.   The reply that the city typically received from the County was that the Request for Proposals (RFP) that they are required to issue to solicit proposals from qualified providers would be issued in the spring of 2019.

 

As the calendar moved, City staff became increasingly concerned whether the RFP would be issued in the spring. In early/mid-June of 2019, the County informed the City that the draft RFP had been transmitted to the State of California as required by law for their review.  It has been at the State for several weeks and the County could not commit to when they would hear back from the State or whether the draft RFP they submitted would be approved by the State.

 

Given the combined lack of staying on schedule and the uncertainty as to when the RFP would be finalized and approved, let alone actually issued to prospective service providers and a contract awarded, the City believes that to ensure the public’s health, welfare and safety and to provide for the continuity of advanced life support transport services that the current agreement, Agreement No. 5587, be amended to continue on a month to month basis for an undetermined amount of time. The current agreement, as amended per this resolution, would continue to be in effect until such time as the County of San Diego and San Diego County Emergency Medical Services have entered into and fully executed a new Agreement to provide these services in the City of San Marcos and the San Marcos Fire Protection District.

 

Environmental Review

There is no environmental impact.

 

Fiscal Impact 

This action will continue the current regimen of providing advanced life support transport services.  The Council adopted Fiscal Year 2019 - 20 Budget assumed that the City would continue to provide these services uninterrupted for the full fiscal year. 

 

If the City is not the provider of these services based on the eventual agreement the County of San Diego approves, staff will return to Council to amend the budget as that outcome would have significant impacts on both revenues and expenditures within the Fire Department’s budget.
