Executive Summary

On October 13, 2020, pursuant to Resolution 2020-8822, the City Council declared parcels identified as APNs 182-076-01, 182-076-02, 182-076-03 (collectively, “Sycamore Property”), and APN 220-420-08 (“Valpreda Property“) to be surplus to the City’s needs.

 

Subsequent to the declaration that the Sycamore Property and Valpreda Property were surplus to the City’s requirements, and pursuant to the requirements of the Surplus Lands Act, applicable agencies were notified of the availability of surplus land for those purposes authorized in the Surplus Lands Act.  One inquiry was received, which concerned the Valpreda Property.  The inquiring party did not wish to pursue the negotiations after learning more about the Property. 

 

As the Surplus Lands Act requirements have been satisfied and no transaction having occurred as a result thereof, it is recommended that the City Council authorize the City Manager and the City Attorney to negotiate, execute, and implement the sale of the Sycamore Property and the Valpreda Property, conditioned on the requirement that the sales price for each Property be at least as much as the last appraisal for the same. 

 

Discussion

After the City Council declared the Sycamore Property and the Valpreda Property to be surplus on October 13, 2020, Staff notified the affected agencies and other parties interested in surplus property as required by the Surplus Lands Act.  One inquiry was received with respect to the Valpreda Property, and no other inquiries were received.  Upon learning that the Valpreda Property was encumbered by a 10-year lease, the inquiring developer determined not to pursue acquisition of said Property.

 

The applicable periods of time required by the SLA to hold the property for potential negotiation and acquisition by applicable agencies expired in December, 2020. 

 

The offers received subsequent to the expiration of the SLA time periods were above the value contained in the last appraisal for the property comprising the Sycamore Property and the last appraisal for the Valpreda Property.  The offer received for the Valpreda property was approximately $140,000.00 above the value noted in the last appraisal for the site. The Sycamore Property received a total of sixty-one offers, many of which are over the appraised value. City staff is  in process of reviewing said offers to identify the best offer for the City.

 

It is recommended that the City Council authorize the sale of the Sycamore Property and the Valpreda Property, provided that the sales price is at or above the last appraised value for the respective Property, and delegate to the City Manager and the City Attorney the authority to negotiate purchase and sale terms, finalize applicable documents, and take any and all actions needed to implement the sales. 

 

Environmental Review

Adoption of the proposed Resolution does not have the potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and thus does not constitute a “project” as defined by Public Resources Section 21065, and is exempt from CEQA or other environmental review pursuant to CEQA Guidelines section 15061(b)(3).

 

Fiscal Impact 

The proposed action would not result in an immediate fiscal impact to the City other than the out-of-pocket costs for appraisal and related services.  The proceeds of any eventual sale of the Sycamore Property and/or the Valpreda Property would benefit the City’s General Fund (Fund 100) in the Fiscal Year 2020-21 Operating Budget, as approved by City Council in Resolution 2021-8855.
