Recommendation
It is recommended that the City Council acting in its capacity as the San Marcos Fire Protection Board of Directors adopt a resolution appointing a new member to the Oversight Board to the Successor Agency to the former San Marcos Redevelopment Agency.

Introduction
In 2011, the California State Legislature passed and Governor Brown signed, Assembly Bill X1 26 authorizing the dissolution of redevelopment agencies throughout California.  In a decision issued on December 29, 2011 regarding California Redevelopment Association v. Matosantos, the California Supreme Court declared the at eh dissolution of all redevelopment agencies in California were dissolved and their successor agencies are required to unwind the activities of the former redevelopment agency.  An Oversight Board, as established in ABX1 26, supervises the activities of the successor agency and the dissolution of the former redevelopment agency affairs.
 
Discussion
The Oversight Board is comprised of seven members appointed by several different governmental agencies; Board of Supervisors, County Office of Education, the Chancellor of the California Community Colleges, the Mayor, and the largest taxing special district.  The largest taxing entity in the former San Marcos Redevelopment area is the San Marcos Fire Protection District.  
 
On April 10, 2012, the San Marcos Fire Protection Board appointed then Fire Chief Todd Newman to serve as the District's appointee to the Oversight Board. Chief Newman retired from the Fire Protection District in May 2014.  Due to Chief Newman's retirement a vacancy was created on the Oversight Board, which needs to be filled.
 
As Chair of the San Marcos Fire Protection District Board, Chair Desmond recommends the appointment of Chief Brett Van Wey to the Oversight Board.
 
Fiscal Impact  
There is no fiscal impact as it relates to the appointment to the Oversight Board.  Board members do not receive any compensation or stipend to serve on the Board.
