Executive Summary

In 2018, Senate Bill 1205 (SB 1205) added California Health and Safety Code section 13146.4, an urgency bill which became effective September 27, 2018. It requires city or county fire departments to ensure that certain structures be inspected on a regular basis, as outlined in sections 13146.2 and 13146.3 of the California Health and Safety Code. Public or private schools used by more than six (6) persons (Educational Group E occupancies) and specified structures used for housing, such as hotels, motels, lodging houses, and apartment houses (Residential Group R occupancies), and those occupancies where the use of a building or structure are for the purpose of providing care or supervision to persons who are incapable of self-preservation without physical assistance, or in which persons are detained for penal or correctional purposes (Institutional Group I occupancies), must be inspected for compliance with building standards pursuant to sections 13146.2 and 13146.3 of the California Health and Safety Code. SB 1205 requires fire departments to report annually to their administering authorities that these mandatory inspections have been conducted.

 

Discussion

During calendar year 2024, the Fire Department completed annual inspections of all buildings referenced under sections 13146.2 and 13146.3 of the California Health and Safety Code. The Fire Department has inspected 28 known educational facilities in the City of San Marcos, as well as 89 known residential occupancies and 9 institutional occupancies.

 

In total, the Fire Department has conducted 126 State mandated annual inspections totaling 823 buildings/structures during the 2024 calendar year and has completed inspections of all known buildings and structures required to be inspected within the San Marcos Fire Protection District’s jurisdictional boundaries, in accordance with the California Health and Safety Code mandates. Further, the acceptance of this Annual State Mandated Inspection Compliance Report and the adoption of the resolution fulfill the statutory requirements contained in California Health and Safety Code sections 13146.2, 13146.3, and 13146.4, as amended by SB 1205.
