Introduction
The Government Code and San Marcos Municipal Code provisions require the City to publish legal notices in an adjudicated newspaper of general circulation for matters such as public hearings, notices inviting bids for public works projects and municipal elections. Public Contract Code Section 20169 requires the City to annually solicit bids from qualified newspapers for legal advertising services for the new fiscal year. The current legal advertising contract holder is The Paper and is an adjudicated newspaper of general circulation in the City of San Marcos.
Discussion
The notice inviting bids for the publication of legal notices was published in accordance with Public Contracts Code Section 20169, and emailed to The Paper, The Coast News, and the San Diego Union-Tribune. The City received bids from the following newspapers:

The Paper, Coast News Inc., and the San Diego Union Tribune are adjudicated newspapers of general circulation in the City of San Marcos. After evaluating the bid, as outlined in the attached criteria, staff recommends awarding legal advertising contract to all three publications during the next fiscal year for the City. This recommendation will provide timely publications of legal notices in accordance with law on any day of the week that may meet project and legal deadlines.
Fiscal Impact
The Fiscal Year 2016-2017 City Clerk budget includes $14,000 for legal advertising. Given any unforeseen volumes of legal advertising, staff expects the approved budget to be sufficient.
