City Council to Approve and Adopt the following, respectively:
1) APPROVE Final Subdivision Map for Tentative Subdivision Map (TSM) 24-0002;
2) ADOPT resolution accepting an Irrevocable Offer of Dedication for a Public Street, Drainage, and Utility easement for a portion of West San Marcos Boulevard as offered by Document 2024-0046378; and
3) ADOPT resolution accepting an Irrevocable Offer of Dedication for a General Utility and Public Pedestrian Access Easement as offered by Document 2025-0093203.

Executive Summary
The proposed Lennar Homes project at the former Sears site (Project) would allow for the development of 71 multifamily residential and 10 commercial condominiums on an approximately 2.8-acre project site located at 1100 West San Marcos Boulevard in the Business/Industrial District.
Staff recommends that the Irrevocable Offers of Dedication for public easements recorded in 2024 and 2025 be accepted to facilitate the construction of public street improvements for West San Marcos Boulevard as part of the Project.
Discussion
Lennar Homes Final Map
On December 2, 2024, the Planning Commission approved the following for the Project:
• Resolution No. PC 24-5133 (Tentative Subdivision Map 24-0002) to create 71 multi-family residential and 10 commercial airspace condominium units on one lot; and
• Resolution No. PC 24-5132 (Multifamily Site Development Plan 24-0006) to allow the construction of 71 multi-family residential condominium units and 2,916 square feet of commercial space.
After a review of the submitted final map and the project conditions, City staff have determined that the Final Map is complete and in conformance with the Subdivision Map Act, the City of San Marcos Subdivision Ordinance, and the conditions of approval for the associated entitlements listed above.
Irrevocable Offers of Dedication
Government Code Section 7050 provides that an irrevocable offer of dedication of real property for any public purposes that has been recorded in the office of the county recorder may be accepted at any time by the city council.
Document 2024-0046378 recorded with the San Diego County Recorder’s Office on February 23, 2024 irrevocably offered to dedicate a public street, utility, and drainage easement for a portion of San Marcos Boulevard. Additionally, an irrevocable offer of dedication for a general utility and public pedestrian access easement was offered by Document 2025-0093203 recorded on April 11, 2025.
The acceptance of these irrevocable offers of dedication would allow for the construction and public maintenance of street improvements for the West San Marcos Boulevard local access lane and appurtenances as part of the Project.
Environmental Impact
The proposed Project and actions have been reviewed for compliance with the California Environmental Quality Act (CEQA) and have been found to be in conformance with the Project’s Categorical Exemption. On December 2, 2024, the Planning Commission approved the entitlements for the Project, including Categorical Exemption EX24-022 identifying the project as In-Fill Development Project pursuant to CEQA Section 15332, Class 32.
Fiscal Impact
There are no direct fiscal impacts associated with the approval of the Final Map. However, the ultimate development of 71 residential and 10 commercial condominiums would improve the City’s property tax/sales tax base.
Annexation into the following Community Facility Districts (CFDs) will ensure the Project pays its share toward affected citywide services: CFD 98-01 Improvement Area 1 (Police Only); San Marcos Fire Protection District CFD 2001-01 (Fire and Paramedic); CFD 98-02 (Lighting, Landscaping, Open Space and Preserve Maintenance); and CFD 2011-01 (Congestion Management). Future City maintenance of the West San Marcos Boulevard improvements is funded by CFD 98-02.
