Executive Summary

In October 1999, at the request of the property owners and in accordance with the terms of the Landscaping and Lighting Act of 1972 (“Act”), the Vallecitos Town Center Street Maintenance District (“District”) was formed by Resolution 1999-5300.  The purpose of the District is to provide annual revenue from properties to pay for street maintenance costs along Center Drive, as well as the energy and maintenance costs of existing traffic signals within the District boundary.

                     

Discussion

The Act requires the implementation of certain proceedings for any fiscal year in which an assessment is to be levied and collected within an existing assessment district formed under its provisions. As part of the proceedings set forth, a report must be prepared describing the assessments that will be levied to pay for costs of improvements. The content of the report is dictated by the California Streets and Highway Code (SHC) section 22567. Since the formation of the District the necessary proceedings have been conducted with respect to levies of annual assessments on properties within the district. A copy of the report has been provided as an attachment to this agenda item. Additionally, the Act requires that the governing body adopt a Resolution of Intention to levy assessments within the District and set a public hearing.

 

The passage of Proposition 218 on November 5, 1996 implemented new procedural requirements for increases in assessments within the District. Any increases of the maximum assessments must be submitted to the qualified electors prior to the increase. The enclosed report does not propose any increase to the maximum assessments beyond the approved annual Consumer Price Index (“CPI”).

 

The City of San Marcos has completed the preliminary Engineer’s Report for the District to levy fiscal year 2021-2022 assessments on properties within the District. These proceedings are intended to provide the City Council with the mechanism to indicate their intent to levy assessments on the District and to set the public hearing date.

 

Fiscal Impact 

The Vallecitos Town Center Street Maintenance District is estimated to produce revenues sufficient to cover all expected and eligible expenses with no subsidy from the General Fund (100) for Fiscal Year 2021-22. The renewal of District assessments will allow for the continued levy on annexed properties within the District. These funds are used to maintain street and signal improvements within the District.
