Executive Summary

The proposed Resolution would approve amendments to the City’s Penalty Fee Schedule for Vehicle Code Violations and Parking Violations to include a penalty fee amount for violations of California Vehicle Code Section 22500(n).

 

Discussion

The California Vehicle Code (“CVC”) was updated in 2023 to add CVC Section 22500(n) which prohibits the parking of a vehicle within 20 feet of a marked or unmarked crosswalk. The City’s penalty fee schedule for parking violations does not currently include CVC Section 22500(n). The California Penal Code penalty schedule for infraction violations of the CVC is established by the Judicial Council in accordance with Section 40310 of the CVC.  The CVC authorizes local jurisdictions to set the penalty schedule for parking infraction violations not specifically provided for in CVC Section 40310. CVC Section 22500(n) is not a section of the CVC that has a prescribed penalty fee amount.

 

The City establishes a penalty fee schedule for parking violations within the City. The most recent amendment of the Penalty Fee Schedule was passed on September 24, 2024 but the penalty fee amount for 22500(n) was not included in that update. The fees shall be charged for the parking or traffic violations of the San Marcos Municipal Code and California Vehicle Code as identified in Attachment 1.

 

Environmental Review

This action does not constitute a “project” as defined under Section 15378 of the California Environmental Quality Act Guidelines (California Code of Regulations, Title 14, Division 6, Chapter 3, Sections 15000 - 15387) and is therefore not subject to environmental review pursuant to Guidelines Section 15060(c)(3).

 

Fiscal Impact 

There is no anticipated fiscal impact associated with this action, as the additions or revisions to the Parking Violation Penalty Fee Schedule are not anticipated to significantly affect current fine and penalty income.
