Executive Summary
On June 8, 2021 The San Marcos City Council scheduled a rent review hearing for July 27, 2021 at 2 PM to review the proposed space rent increase for Lakeview Mobilehome Park. Subsequently, the mobilehome park resident/tenant's representative and mobilehome park owner's representatives requested that the hearing be delayed to allow the parties to continue mediation efforts, the results of which may allow for the withdrawal of the petition and subsequent cancellation of the hearing. Staff recommends that City Council reschedule the hearing to October 12, 2021 at 2 PM to allow for the ongoing mediation process to continue.

Discussion
Pursuant to the Mobilehome Rent Review procedures, if a different hearing date is agreed upon by all interested parties, the hearing can be scheduled outside of the typical 40 days to 60 days from the receipt of the petition by the City Council, which in the case of the Lakeview petition was June 8, 2021. The 40 - 60 day time frame for a scheduled hearing would result in a date between July 18, 2021 and August 7, 2021. The City Council had scheduled a hearing date of July 27, 2021.

Per the request of the park owner and the park tenant's representatives, the hearing date may be delayed. Delaying the hearing date will allow the parties to continue to engage in negotiations separate from the Mobilehome Rent Review Commission process in the hopes that they will be able to reach a mutually acceptable resolution.
