On March 17, 2025, Planning Commission considered the Water Mill Homes project, now known as Summer Ranch Estates, and approved the project, including adoption of Mitigated Negative Declaration (ND22-007). The proposed summary vacation of this public right-of-way easement was depicted on TSM21-0004 as approved by Planning Commission at that March 17, 2025 hearing.
Background
On March 17, 2025, the Planning Commission approved a Tentative Subdivision Map to allow the subdivision of up to nine single-family residential lots on a vacant 10-acre site located at the southwest corner of Cox Road and Mulberry Drive within the Agricultural (A-1) Zone. Cox Road was dedicated in-fee title for public street purposes by Map 806, recorded December 21, 1895. The portion of Cox Road right-of-way proposed to be vacated is depicted in Attachment A[SN1][KC2]. The applicant submitted for staff review the summary vacation for a portion of Cox Road, VAC25-0001 on May 29, 2025.
Discussion
California Streets and Highways Code (CSHC) Section 8334(a) provides that the legislative body of a local agency may summarily vacate an excess right-of-way or highway not required for street or highway purposes.
