Recommendation
APPROVE the Final Subdivision Maps for TSM 400, Phase 5, Units 8 and 9 for the Project located along Ledge Drive beginning approximately 450 feet north of San Elijo Hills Road. The subdivision will consist of two maps, one for each unit and results in 48 lots. Staff also recommends the acceptance of the General Utility, Municipal Access, and Emergency Access Easements, Drainage Easement and Open Space Easement as depicted on the maps.

Introduction
The Tentative Subdivision Map (TSM) 400 was approved by City Council Resolution Nos. 98-5024 and 98-5025 on May 12, 1998 in the Specific Plan Area (SPA) zone within the San Elijo Hills SPA. Due to the large scale of the project, the final mapping was phased and the subdivider indicated his intent to file multiple final maps on the subdivision conforming to the Subdivision Map Act (SMA) GC 66463.1(a).

The "Master Map", TSM 400, Phase 5 - Unit 1 was approved by the City Council on December 13, 2005. Said map created parcels to be further subdivided and/or developed by merchant builders. The maps presented herein, TSM 400, Phase 5, Units 8 and 9, Planning Area O, subdivide a portion of such parcels for the merchant builders to use for construction and allow for the installation of roadway and utility infrastructure.

Discussion
After review of the submitted final map and careful review of the project records, the final map has been found to be complete and in compliance with the SMA, the City of San Marcos Subdivision Ordinance and the conditions of approval for TSM 400.
