INTRODUCE (First Reading) of an ordinance amending the San Marcos Municipal Code to assign a new Chapter number to the previously adopted Transportation Demand Management provisions, and finding that said amendment is categorically exempt from CEQA review:

a. Categorical Exemption (EX24-0001)
b. Ordinance No. 2024-1543 (TA24-0001) to assign a new chapter number, Chapter 20.360, to the previously adopted Transportation Demand Management Ordinance.

Executive Summary/Discussion
The City Council approved and adopted Ordinance No. 2023-1539, the Transportation Demand Management (TDM) Ordinance, on December 12, 2023, to be included in Title 20. This new Chapter was assigned Chapter No. 20.350. However, because that Chapter number is currently in use, a new Chapter number is needed for the TDM Ordinance. Staff requests that the City Council consider assigning a new Chapter number, Chapter 20.360, for the TDM Ordinance.

Environmental Review
The proposed Text Amendment to re-number the TDM Ordinance is exempt from environmental review under CEQA pursuant to Section 15061(b)(3), Review for Exemptions - Common Sense Rule, in that it can be seen with certainty that there is no possibility for this action to have a significant effect on the environment.
