Executive Summary
A storm drain which crosses San Marcos Boulevard to the west of Viewpoint Drive was damaged by an adjacent private development during a repair effort. This damage has resulted in a lack of capacity for proper function. The proposed project will establish a budget to repair the storm drain utilizing funding from the development which damaged the drain. To ensure an expeditious repair of the storm drain and limit noise impacts to nearby residents ,a waiver of Resolution 2002-5868 is proposed to allow for the City Engineer to authorize day work as may be required for this project.

Discussion
In 2023, a private party advised the City that repair efforts conducted on its private drainage system had resulted in the deposit of cementitious material into the downstream City storm drain pipe under San Marcos Boulevard. The City's efforts to remove the material have been ineffective thus far. The private party has executed a reimbursement agreement to fund the restoration of the City's pipe capacity. At this juncture, staff recommends the creation of a new Capital Improvement Program project for the design and construction of measures to restore capacity of the pipe as indicated in the reimbursement agreement.
